These Terms of Use and Service (“Terms”) govern access to the public websites operated under fundeed.io (the “Website”) and the Fundeed software platform, including its applications, dashboards, AI-assisted features, reporting tools and related services (the “Service”). Please read them carefully before using Fundeed.
Fundeed is a software product operated by Binair CommV, a business established in Belgium (“Fundeed”, “we”, “us” or “our”). For contractual questions, contact privacy@fundeed.io; for security matters, contact security@fundeed.io. Any additional company identification and contact details provided in an applicable order or invoice form part of the relevant customer relationship.
The Service is intended primarily for professional and business use by investment managers, funds, private-market investment teams, portfolio companies and their authorized representatives. If you register or use the Service on behalf of an organization, you confirm that you are authorized to act for that organization and bind it to these Terms. You must have legal capacity to enter into a contract and use the Service in compliance with applicable law. If mandatory consumer protection rules apply to you, nothing in these Terms limits those rights.
You may browse the Website, read its materials and contact us through its forms for lawful purposes. Website information, examples, demonstrations and sample portfolio data are illustrative and may change. Submitting a contact form does not create a customer contract, an obligation to purchase or an agreement for advisory services. Do not submit confidential portfolio or personal data through general enquiry forms unless reasonably necessary.
The Service may require an account and membership in a workspace or organization. You are responsible for accurate registration information, appropriate access permissions, protecting your login credentials and promptly informing us about suspected unauthorized access. Administrators are responsible for managing invited users and their permissions. Each user must access only data they are authorized to view. We may restrict access where reasonably necessary to address security, misuse or legal requirements.
Fundeed may offer free and paid plans, trials, usage allowances and credit-based features. Current plan features, prices, included allowances, credit consumption and any applicable taxes are presented in the Service or at checkout and may vary by plan. A free plan may have limits; paid capabilities may be unavailable after the relevant allowance or subscription expires. Credits are units of Service usage, not currency or stored monetary value. Unless expressly stated otherwise at purchase, credits cannot be exchanged for cash or transferred between unrelated customer accounts. Specific expiry, rollover and refund conditions, if any, must be shown with the relevant offer.
Where you purchase a paid subscription, you authorize the disclosed charges and applicable taxes under the plan and billing interval selected at checkout. Payments may be processed by a third-party payment provider. Automatic renewal applies only where clearly disclosed when subscribing. You can manage or cancel a subscription using the available billing controls or by contacting us; cancellation takes effect under the terms shown for that subscription, and access to paid features may continue through the paid period. Refunds are governed by the applicable offer and mandatory law. We will communicate material price or plan changes as required by law.
You and your organization retain ownership of the information, files, company updates, metrics, investment details, reports and other materials you submit to or make available through the Service (“Customer Data”). You grant Fundeed a limited right to host, process, analyze, transform, display and transmit Customer Data only as reasonably necessary to provide, secure, maintain and support the Service, comply with law, or as otherwise authorized by you. You confirm that you have the rights and permissions needed to supply Customer Data, including any third-party or personal information. You are responsible for its accuracy, legality and appropriate classification.
Fundeed may use automated processing and artificial intelligence to extract information, highlight missing inputs, draft investor updates, identify potential risks and produce analyses or suggested actions. Such outputs may be incomplete, inaccurate, outdated or based on assumptions or poor-quality source data. You must independently review and validate all material facts, calculations, valuations, financial conclusions, compliance statements and external-facing reports before relying on or distributing them. Fundeed does not make investment decisions for you, act as a fiduciary, or provide regulated investment, legal, tax or accounting advice. You remain responsible for your investment decisions and published communications.
We recognize that Customer Data may contain commercially sensitive information. We use it for the purposes permitted by these Terms and do not acquire ownership of it. We may disclose it to personnel and service providers where reasonably required to operate the Service and subject to appropriate confidentiality and data-protection obligations, or where disclosure is legally required. Personal data is handled as described in our Privacy Policy. When applicable law requires a separate data processing agreement because Fundeed processes personal data on behalf of a business customer, the parties should put that agreement in place before such processing. Do not enter information you are not permitted to disclose.
You must not use the Website or Service to break the law, infringe intellectual-property or privacy rights, submit malicious code, probe or bypass security controls, access another customer’s workspace, scrape at an abusive scale, reverse engineer protected software except where mandatory law permits, resell access without permission, or interfere with the availability of the Service. You must not use AI functionality to generate misleading or unlawful investor communications. We may take proportionate steps, including suspension, to stop abuse and protect users and systems.
Fundeed and its licensors retain all rights to the Website, Service, software, interface, design, documentation, trademarks and underlying technology, excluding Customer Data. Subject to these Terms and payment where applicable, we grant your organization a limited, non-exclusive, non-transferable right to access and use the Service for its internal business purposes during the applicable service period. You may not imply sponsorship or use our branding except as permitted in writing.
We aim to operate the Service reliably but do not promise uninterrupted, error-free operation. Maintenance, upgrades, incidents, supplier outages and changes to third-party integrations may affect availability or functionality. We may update the Service and its features, provided changes to paid commitments are handled in accordance with applicable agreements and law. Third-party websites, data sources and services are governed by their own terms; Fundeed is not responsible for their independent services or content.
You may stop using the Website at any time. Customer subscriptions and workspace access may be cancelled or terminated under the applicable plan or written agreement. We may suspend or terminate access for material breach, non-payment after appropriate notice, unlawful activity, or serious security risk, subject to applicable law and proportionality. Following termination, access to the Service may cease. Where available, export important Customer Data before termination. Retention and deletion of Customer Data follow the applicable agreement, our Privacy Policy and legal obligations; do not assume data will remain accessible indefinitely.
The Website is provided for general information. To the extent permitted by law and unless otherwise agreed in writing, the Service is provided with reasonable care and skill but without a guarantee that every insight, prediction or report is complete or suitable for a particular investment purpose. You remain responsible for the accuracy of submitted data, the review of generated outputs, and your business, regulatory and reporting obligations. Nothing here excludes warranties or remedies that cannot lawfully be excluded.
Each party remains responsible for losses it causes under applicable law and any express written agreement. To the extent permitted by law, Fundeed is not liable for losses resulting solely from inaccurate Customer Data, unreviewed AI outputs, third-party services or decisions made independently of Fundeed’s obligations. Neither party excludes or limits liability where doing so would be unlawful, including for fraud, intentional misconduct or other non-excludable liability. Any additional agreed liability limits in a signed contract or order will take precedence over this section to the extent permitted by law.
We may revise these Terms to reflect changes in our services, practices or legal requirements. The current version will be made available on the Website with an updated date. Where a change materially affects an existing paid subscription, we will provide notice and any rights required under applicable law or the applicable agreement. Continued use after a change takes effect may constitute acceptance where legally valid.
These Terms are governed by Belgian law, subject to any mandatory laws that apply to a particular customer. The competent Belgian courts will hear disputes to the extent permitted by applicable law and any more specific written agreement. We encourage you to contact us first so we can attempt to resolve concerns informally.
18. Optional Google integrations and connected data
Google sign-in authenticates your identity but does not itself grant Gmail or Calendar access. If you separately authorize optional integrations, Fundeed may read calendar events and carry out user-requested meeting changes, or retrieve Gmail messages and PDF attachments for portfolio-update review. Gmail content may be retrieved before sender-domain filtering. Connected content can be processed through the configured AI service as described in the Privacy Policy. Disconnecting a Google connection does not automatically delete information already imported into Fundeed. Data-use purposes, categories, recipients, retention criteria and privacy choices are described at fundeed.io/privacy-policy. Users should review Google permissions before enabling a connection. Any applicable Google API user-data restrictions and requirements must be respected; these Terms do not authorize a use or transfer prohibited by Google or data-protection law.
